Terms and Conditions
By agreeing to use Fiona Cousins Midwifery Services, either verbally, or with written consent, you agree to abide by the following terms and conditions:
In the event of any inconsistencies between these conditions and the terms and/or the conditions of an order placed by you, these conditions shall prevail unless otherwise agreed in writing by the proprietor Fiona Cousins.
Delivery of Services
Services will be offered via telephone or video, face to face, in your own home or in a suitable, mutually agreed environment. Fiona Cousins Midwifery Services will work together with women and their families who require assistance and support in relation to maternity and newborn care.
Payment
All expenses incurred will be charged to you and invoiced within 30 days
Fees are payable to Fiona Cousins Midwifery Services within 7 days of the date of the invoice
Payment may be made in cash or via bank transfer (account details will be given on the invoice)
Cancellation
If you cancel an appointment with Fiona Cousins Midwifery Services within 24 hours of the scheduled appointment, you will be liable for the full consultation fee.
If a revised appointment is scheduled, the full consultation fee will be charged.
Limitation of liability
The following provisions set out the financial liability of Fiona Cousins Midwifery services (including any liability for the acts or omissions of its employees, agents and subcontractors) to you in respect of:

any breach of this agreement

any representation, statement or tortuous act or omission, including negligence, arising under or in connection with this agreement

All warranties, conditions and other terms implied by statute or common law are to the fullest extent permitted by law, excluded from this agreement

Nothing in this agreement excludes or limits the liability of Fiona Cousins Midwifery Services for death or personal injury caused by Fiona Cousins Midwifery Services negligence, or for fraud or fraudulent misrepresentation

Subject to the above clauses:

Fiona Cousins Midwifery Services liability for direct loss of damage in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance of or failure to perform this agreement shall be limited to the price paid under this agreement

Fiona Cousins Midwifery Services shall not be liable to you for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise (in each case, whether direct, indirect or consequential) or from any costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection to this agreement.

The parties will attempt in good faith to resolve any dispute or claim arising out of, or relating to, this agreement promptly through negotiations between them
Personal Information
Information communicated between Fiona Cousins Midwifery Services and you, whether written or verbal, shall be deemed as confidential
Personal Information will be stored securely by Fiona Cousins Midwifery Services.
Information shared with an expert regarding your status, will be done only with agreement and consent from you
Introduction of the Expert
Experts may be sourced for you by Fiona Cousins Midwifery Services at your request if deemed necessary
Fiona Cousins Midwifery Services endeavors to ensure, but does not guarantee, the suitability of any expert introduced to you
The final decision to employ and engage the expert is your sole responsibility
Professional Accountability
Fiona Cousins Midwifery Services will adhere to all professional standards and codes of conduct in accordance with the registration bodies (International Board of Lactation Consultant Examiners, The Nursing and Midwifery Council, UpSfb, INAMI)
